Advize Health’s very own Eric Rubenstein has been featured in a recent Law360 article after participating in a series of discussions on healthcare fraud, waste, and abuse across the NY Metropolitan area this week. Rubenstein spoke candidly about his experience as an OIG Special Agent dealing with the fraud schemes associated with genetic testing and telehealth.

Law360 (September 25, 2019, 7:41 PM EDT) — The U.S. Department of Justice is taking aim at alleged telehealth schemes that fraudulently billed hundreds of millions of dollars to Medicare for genetic testing and other treatments, court documents showed on Wednesday.

The cases are not the first to go after alleged genetic testing fraud. Eric Rubenstein, a retired special agent at the Department of Health and Human Services, said that the first such case was brought in 2015 and charged patient recruiter Seth Rehfuss.

Rubenstein, now a consultant at Advize Health LLC, said he was not surprised to hear about the allegations in the Patel case of kickbacks worth half the cost of a test.

“When you are constantly using recruiters, it’s almost like an investment in which you are collecting a monthly stipend,” Rubenstein said.
